1. István Militária Ltd. and Krisztina Antikvárium (hereinafter referred to as Auctioneers) are commissioned by the Consigners to organise and run the public auction. Prospective purchasers (hereinafter referred to as Bidder or Bidders) acknowledge the Terms and Conditions of Sale by participating.
2. The lots offered in the catalogue can be viewed prior to the auction and they will be auctioned in the same condition, so Bidders have the opportunity to examine the items personally and to define their features.
3. Prospective Bidders (after supplying their names and address) will be issued a bidding card. Bidders who are not known by Auctioneers only receive their bidding cards after presentation their identity cards. During the live auction Bidders indicate their bids by showing up their bidding cards.
4. Bid increments are determined by Auctioneers. Usually 5-10% increments are applied.
5. With a successful bid, the sale between the Auctioneers and the Bidder is realized.
6. The purchase price consists of the hammer price + a 15% buyer’s premium. Bidders may receive the won item immediately – on the spot, after a cash payment (during the auction as well).
7. Absentee bids: Bidders can only place absentee bids on the hammer price personally or in writing (e-mail or letter) during the exhibition period. Bidders may be required to pay a 20% deposit of the amount of the absentee bids, which will be calculated into the final price in case of a successful bid. In case of unsuccessful bidding, the whole deposit is returned without any deduction. During the live auction Bidders who place absentee bids are represented by the Auctioneers. In case of more absentee bids of the same amount, the earliest will be valid. However, if there is a bid in the same amount on the spot, it will take precedence over the absentee bid.
8. Receiving items: Bidders may receive the won item immediately – on the spot, after a cash payment (during the auction as well). Bidders may be asked to pay a 20% deposit if they do not pay for the won item on the spot. The whole purchase price is due in 14 days after the auction. If Bidders do not fulfil this obligation, their bids become invalid and Auctioneers are entitled to keep the deposit. Lots purchased with absentee bids, or items not collected at the live auction can be collected (after full payment) at Krisztina Antikvárium or they can be sent by mail (on request).
Bidders should make all payments in cash, but on request and with previous indication by the Bidder, payments can be settled through a wire transfer as well. Postal delivery (and packaging) costs and its risks are to be borne by the Bidders.
9. Auctioneers do not bear any responsibility for the condition of the items not collected till the 14th day of the date of sale. Thereafter, Auctioneers are entitled to return these items to the Consigners without any warning issued to the successful Bidder!
10. If the payment for a won item is not received in 14 days, Auctioneers are eligible to file any legal claims against the successful Bidder.
11. Should a national public collection (any state owned museum of national competence) claim any item, it may exercise its right of pre-emption at the reached price.
12. In case of any controversy, the Auctioneers may reauction the item.
13. Unsold items can continuously be requested to be reauctioned.
