conditions of sale

1. The auction organises, handles and conducts by the auctioneer, Villás Gallery, acting as an agent on behalf of the vendor. The lots are called up in the same succession as in the catalogue. The auctioneer announces the catalogue number of the lot in question and the buyers indicate their wish to bid by raising their hand. 

2. The highest bidder acknowledged by the auctioneer shall be the buyer at the hammer price. However, in the case of lots marked as „VÉDETT” (protected items) in the catalogue, the Hungarian museums reserve the right to buy the item at hammer price. (Act LXIV of 2001)

3. The buyer has to pay 20% of the hammer price, as deposit, in cash immediately after the sale. In case the whole price is paid, the buyer can have the object after the sale. The commercial agent allows a fve-day period from the date of the auction for the payment of the balance amount between the deposit and the full purchase price. The purchase price includes the amount of the deposit provided the deadline set for the balance payment has been met. The Auction House reserves the right to terminate the sale and purchase agreement unilaterally if the purchase price has not been paid in full by the set deadline. In this case the paid deposit is not reimbursable to the buyer.

4. The buyer has to pay the agent fee of mediation (commission), whose amount is 20%. The comission fee includes VAT.

5. The buyer is responsible for the package and transport of the purchased item at his own cost and risk once the full purchase price has been paid. The auctioneer is not responsible for any damage occuring after the sale. In case the buyer fails to ship the goods – in spite of being called upon to do so – after 6 months the agent has the right to sell the item and will preserve the amount for the buyer as deposit minus expenses.

6. All collusion or conspiracy on behalf of any party, planning to force a third party to make an unreasonable high bid, and thus infict any loss on the third party is strictly forbidden.

7. All items are available for inspection prior to the auction and during the sale.

8. Descriptions and illustrations in the catalogue are for identifcation only. The bidder is responsible for inspecting the condition of the auction lots – prior to the auction – and for deciding whether this is in accordance with the catalogue description.

9. All items are sold with all faults and imperfections they may have at the time of the sale without any guarantee.

10. No object will be sold for an amount less than the estimate price in the catalogue. The hammer price develops based on the public purchase bids of the auction buyers and for this reason the Auction House shall not be held liable for the hammer price of a given auction item. The Auction House does not undertake any liability for that it will put the same item for auction at the same price later.

11. The Auction House does garantee the genuineness of all the items at the auction. The auction will not accept any complaints after the lot has been knocked down, unless the item is not genuine despite being declared so in the catalogue. In such case the buyer may contest the sale in writing within 30 days of his/her initial doubt to the origins or the genuineness of the item, but no later than 5 years after the date of the auction.

12. The Auction House udertakes to re-purchase the item from the buyer for a price including the hammer price and the agent fee of mediation, provided an independent expert gives a reliable opinion proving that the item is not genuine.

13. No objects marked “VÉDETT” (protected) in the catalogue may be taken abroad. Owners of protected goods will be registered by National Centre for Cultural Heritage Management which should be notifed in the case of any change in ownership.

14. Unsold items may be asked to be re-auctioned by the commercial agent at the end of the sale.

15. Data protection: the personal particulars of the auction buyers (name and address) shall not be made available to third parties, and shall not be made public by the Auction House. The Auction House shall delete without delay the registered personal particulars from its records after the auction, except for the particulars of the buyer of the given auction item, provided that such particulars are required for the execution of the sales contract, and/or in the other cases required by the law.
