These Terms and Conditions of Auction shall apply between the Seller(s), as consigner(s), (hereinafter referred to as: Seller(s)) and Boda Antikvitás (H-1111 Budapest, Bercsényi u. 3.), as auctioneer trading representative (hereinafter referred to as: Auctioneer). The Auctioneer puts up the items transferred to him for auction under the following terms and conditions:
1. The items transferred to the Auctioneer (hereinafter also referred to as: lots) will be auctioned in the order of their appearance in the auction catalogue (brochure) in such a way that the Auctioneer verbally announces the identification number of the item, briefly describes each lot and announces the starting price thereof.
2. All auction items go under the hammer in the same condition as they were exhibited. Therefore, the Bidders shall ascertain the condition of the items by themselves during the pre-exhibition taking place for 10 days prior to the auction.
3. The auction Buyers indicate their intention of purchase by holding up their bidding disks and make their purchase offers. The Auctioneer sells the item submitted for auction to the Bidder offering the highest price.

  • From 10.000 to 20.000: 1.000
  • From 20.000 to 50.000: 2.000
  • From 50.000 to 100.000: 5.000
  • From 100.000 to 200.000: 10.000
  • From 200.000 to 500.000: 20.000
  • From 500.000 to 1.000 000: 50.000
  • From 1.000.000 to 2.000.000: 100.000
  • From 2.000.000 to 5.000.000: 200.000
  • From 5.000.000 to 10.000.000: 500.000
  • From 10.000.000 to 20.000.000: 1.000.000
  • From 20.000.000 to 50.000.000: 2.000.000

4. The sale-purchase deal is made by hammering (knocking down of the lot). The right to purchase the lot is obtained by the auction Buyer who made a valid purchase offer at the highest price, unless, in case of protected objects, the Hungarian State exercises its pre-emptive right provided by Act LXIV of 2001.
5. Any kind of collusion or conspiracy intended to entice third parties to offer an unrealistically high purchase price and thus cause damage or loss to third parties is prohibited.
6. The Buyer obtains the ownership to the lot, if he has paid the purchase price in full and taken over the lot from the Auctioneer.
7. The purchase price is made up of the aggregate amounts of the hammer price and the buyer’s premium.
8. Calculated on the hammer price, the Buyer is obliged to pay 20% buyer’s premium, which consists of 14% agent’s commission, 5% royalty fee and 1% cultural contribution.
9. The Buyer must pay 20% of the hammer price as a deposit, in cash, immediately at the close of the auction. Following the payment of the portion of the purchase price exceeding the deposit the item may be immediately transferred to and received/taken away by the Buyer, or there is a one-week (7 days) grace period allowed for the Buyer to pay the portion of the purchase price exceeding the deposit at the store of Boda Antikvitás (H-1111 Budapest, Bercsényi u. 3.).
The amount of the deposit is included in the purchase price in the case if the purchase price has been paid in full within the deadline. Failing this, the purchase offer of the Buyer becomes null and void and the deposit will not be returned.
10. The Auctioneer undertakes free home delivery for the Buyer in the area of Budapest, within 10 days after the auction. In case of failure of the above, the Auctioneer will not be liable for any loss or damage to the item and will charge a 5% monthly storage fee on the purchase price from the 12th day after the auction. If the auction Buyer fails to take away the item within 3 months of the auction, the Auctioneer – after notifying the Buyer in writing – may freely sell the item and after deducting his costs and expenses will keep the remaining amount as a deposit for the Buyer.
11. Items designated in the Auction Catalogue (brochure) „Protected” („Védett”) or „No export” must not be definitely exported from the territory of Hungary under point b) of Paragraph (1) of Section 59 of Act LXIV of 2001.
12. If the Buyer does not wish to be present in person at the auction, then on the basis of the purchase order issued by him, the Auctioneer submits the purchase offers on behalf of the Buyer in accordance with the purchase order.
A purchase order may be arranged during the time of the exhibition or online via email sent to electronic mail address 2000@bodaantik.hu.
To accept the purchase order, 20% of the bid is required to be paid in advance, which will be refunded in the case if the bidding is not successful. The sum may be paid in advance in cash at the store of Boda Antikvitás (H-1111 Budapest, Bercsényi utca 3.) or by transferring the amount to the bank account No. 10101535-63436900 -01003009 held at Budapest Bank.
If the purchase bid is successful, the whole amount of the advance payment shall be considered as deposit. If a third party places a higher bid for the same lot, or the bidders at the auction place a higher bid, then the amount of the advance payment will be refunded without any deduction to the absentee Bidder after the auction.
13. Boda Antikvitás does guarantee the authenticity of all the items auctioned.
No complaint or objection is admissible, after the lot has been knocked down, unless the item is counterfeit. In such a case the auction Buyer may raise an objection in writing – supported with reliable opinion of an independent expert proving that the item is not genuine - within 3 (three) months of his initial doubt as to the origin or authenticity of the item, but no later than within 5 (five) years after the date of the auction.
14. Issues not regulated in the points of these Terms and Conditions shall be governed by the provisions of the Civil Code; in case of disputes the Parties subject themselves to the jurisdiction of the Fővárosi Bíróság (Budapest Municipal Court, Hungary).
