1. The auction organises, handles and conducts by the auctioneer, Villás Gallery, acting as an agent on behalf of the vendor. The lots are called up in the same succession as in the catalogue. The auctioneer announces the catalogue number of the lot in question and the buyers indicate their wish to bid by raising their hand.
2. The highest bidder acknowledged by the auctioneer shall be the buyer at the hammer price. However, in the case of lots marked as „VÉDETT” (protected items) in the catalogue, the Hungarian museums reserve the right to buy the item at hammer price. (Act LXIV of 2001)
3. The buyer has to pay 20% of the hammer price, as deposit, in cash immediately after the sale. In case the whole price is paid, the buyer can have the object after the sale. The commercial agent allows a five-day period from the date of the auction for the payment of the balance amount between the deposit and the full purchase price. The purchase price includes the amount of the deposit provided the deadline set for the balance payment has been met. The Auction House reserves the right to terminate the sale and purchase agreement unilaterally if the purchase price has not been paid in full by the set deadline. In this case the paid deposit is not reimbursable to the buyer.
4. The buyer has to pay the agent fee of mediation (commission), whose amount is 20%. The comission fee includes VAT.
5. The buyer is responsible for the package and transport of the purchased item at his own cost and risk once the full purchase price has been paid. The auctioneer is not responsible for any damage occuring after the sale. In case the buyer fails to ship the goods – in spite of being called upon to do so – after 6 months the agent has the right to sell the item and will preserve the amount for the buyer as deposit minus expenses.
6. All collusion or conspiracy on behalf of any party, planning to force a third party to make an unreasonable high bid, and thus inflict any loss on the third party is strictly forbidden.
7. All items are available for inspection prior to the auction and during the sale.
8. Descriptions and illustrations in the catalogue are for identification only. The bidder is responsible for inspecting the condition of the auction lots – prior to the auction – and for deciding whether this is in accordance with the catalogue description.
9. All items are sold with all faults and imperfections they may have at the time of the sale without any guarantee.
10. No object will be sold for an amount less than the estimate price in the catalogue. The hammer price develops based on the public purchase bids of the auction buyers and for this reason the Auction House shall not be held liable for the hammer price of a given auction item. The Auction House does not undertake any liability for that it will put the same item for auction at the same price later.
11. No objects marked “VÉDETT” (protected) in the catalogue may be taken abroad. Owners of protected goods will be registered by National Centre for Cultural Heritage Management which should be notified in the case of any change in ownership.
12. Unsold items may be asked to be re-auctioned by the commercial agent at the end of the sale.
13. Data protection: the personal particulars of the auction buyers (name and address) shall not be made available to third parties, and shall not be made public by the Auction House. The Auction House shall delete without delay the registered personal particulars from its records after the auction, except for the particulars of the buyer of the given auction item, provided that such particulars are required for the execution of the sales contract, and/or in the other cases required by the law.
Bids can be made in person, throught the commercial agent or over the phone. The following rules shall apply:
Information for bidders
1. All bidders are requested to use their paddle when bidding in order to help make the auction process more effective. The use of numbered paddles will help the auctioneer to identify one’s bid. In case one’s bid has benn accepted, please ascertain that your paddle has been registered.
In case of any problems, please notify the auctioneer immediately.
Bidders can have their paddle numbers registered for their convenience. All items awarded to the bidder will then be collected under the registered paddle number and the bidder will have the right to settle payment for all items in one amount at the end of the bidding.
2. Absentee bids will be made on the bidder’s behalf by the commercial agent in accordance with the authorisation given by the bidder to agent. Such bids can be submitted to the Villás Gallery, during the exhibition, or via fax (fax no.: +36-52-456-600). The commercial agent will make every effort to secure the item at the lowest price to the absentee bidder. In case two absentee bids of the same price indication are submitted for one auction lot, the one submitted first will take precedence. Please always indicate your price limit where you would stop bidding for the item if you participated in person at the auction. Absentee bids submitted without a price limit indicated will not be accepted.
3. For absentee bids, 20% of the indicated limit price amount will be paid in cash as a deposit, for which a receipt will be iven to bidder. If another absentee bid with a higher price limit indicated is submitted for the same lot, or higher bids are placed during the auction, the deposit will be returned to the bidder against the issued receipt without any deduction after the auction. If the absentee bid is successful, the deposit will be included in the purchase price.
4. The purchase price shall be settled in cash and wiring.
5. In case of wiring, please indicate the amount in HUF in order to avoid changing rate differences.
