conditions of sale



1. The INTERGALÉRIA MŰKERESKEDÉS-AUKCIÓSHÁZ (INTERGALÉRIA ART-DEALER’S SHOP-AUCTION HOUSE) organizes and manages the auction on sellers authority as commercial representative.
2. The lots are announced in the order of the Catalogue, so that the manager of the auction announces the catalogue number and upset price by word of mouth, whereof those who intend to buy make their offer by a show of hands.
3. The right to buy the object is gained by buyer, who gives the highest price offer, unless the Hungarian museum enforces its pre-emptive right guaranteed in the act No. CXL (1997 year) in case of the protected work of art.
4. The auction house as commercial agent has authority to enter into contract of sale with the buyer offering the highest price during the auction and receiving the purchase price for the good of consigner in the name and on behalf of the consigner. In compliance with this the contract of sale is concluded between the consigner and buyer.
5. The buyer has to pay the purchase price in cash or its 20% as deposit on the auction on the spot. In case the total purchase price is paid in one sum on the auction, the object could be taken on the site. In case of payment of 20% deposit the remaining part should be paid in 7 days. The sum of the deposit is included into the purchase price in case of the effect payment in due term. If the auction buyer does not presents oneself till the given deadline, the auction house would consider the offer of the buyer invalid, keep the sum of the deposit.
6. The buyer pays the 21% of the adjudicated price as commission fee.
7. The buyer has to take charge of the transportation of the purchased object after remitting the purchase price, on his own obligation and responsibility. In case of neglecting of this the commercial representative does not take responsibility for the damage of the object, charges 5% storage fee per month from the seventh days after the auction.
8. If the buyer does not carries away the purchased object despite of call after the auction, the commercial representative would sell the object free after 6 months, after the deduction of costs the remaining sum would deposit to the benefit of the buyer.
9. All kind of agreements or undertaking aiming at persuade third persons to offer high price and in that way cause loss are forbidden.
10. All objects can be viewed on the exhibition prior to the auction. The objects are sold in condition as they are being during the time of the exhibition, without warranty with all their defects and flaw. The descriptions and illustrations in the catalogue serve exclusively for the identification, so the buyers themselves should be convinced of the condition of auction lots and of that whether the lots are in compliance with the descriptions of the catalogue.
11. The INTERGALÉRIA warrants the originality of the objects shown on the auction.
12. After knocking down the auction house does not consider any complaint, except if the object is false, though it is shown as original one. In this case the buyer can complain in the mode of action and within time, settled in the Code of Civil Procedure.
13. The objects taken to the auction can not be purchased under the upset price. The commercial representative does not take any responsibility for the price offer of the auction buyer, paid auction price.
14. In case the buyer does not want to take part in the auction, the commercial representative could put up officially for sale on the base of the purchase commission, according to the commission. 20% of the price settled in the commission has to be paid in advance. The earlier received commission gets preference in case of the purchase commission with the equivalent sum. If a third person gives purchase commission for higher sum or the participants of the auction offer a higher price for the same object, the principal should receive back the advance without any deduction against receipt of purchase commission. If the purchase commission is successful, the advance has to be considered as deposit.
15. The work of art marked “PROTECTED” in the catalogue can not be taken out of Hungary. The owners of objects marked as “PROTECTED” are registered by the museums, reporting of the change in ownership is compulsory.
16. One can ask for the new auction of the objects what have not been sold from the commercial representative at the end of the auction.
17. If the auction buyer wishes to deliver the object abroad, further 3% of the knock down price should be paid with the aim of getting the official export permissions. The further expenses connected to the transportation abroad (package, shipping, insurance) charge the buyer’s account. Please give information about your export plan before paying.
18. The provisions of the Code of Civil Procedure are authoritative in questions non-regulated in recent agreement, in case of unsettled questions the parties submit themselves to the competency of the Court of Capital.
